Privacy Policy.

Last updated: May 2026

We're Btch Agency and yes, we take your privacy seriously. No fluff, no drama, just straight talk about what we collect, why we collect it, and what we do with it. We built this agency on clarity and systems, and that applies here too. Read on.

01. Who We Are

Btch Agency ("we," "us," or "our") is a branding, growth, and systems agency operating at btchagency.com. We serve clients across the United States, Latin America, and beyond. When you visit our website, fill out a form, book a call, or send us an email, you're sharing information with us. This policy explains exactly what happens with that information.

02. What We Collect

We collect information in two ways: stuff you give us directly, and stuff that gets collected automatically when you visit our site.

Information you give us:

  • Your name and email address when you subscribe to our newsletter or fill out a contact form
  • Your name, email, and any details you share when you book a call or inquiry
  • Any information you voluntarily share when communicating with us via email or social media

Information collected automatically:

  • IP address and browser type
  • Pages you visit and how long you stay (we like knowing what content resonates)
  • Referring URLs, meaning how you found us
  • Device type and operating system
  • Cookies and similar tracking technologies (more on that below)

03. How We Use Your Information

We use what we collect to run our business properly and serve you well. Specifically:

  • To respond to your inquiries and communicate with you
  • To send you our newsletter and marketing insights (only if you opted in, we don't spam)
  • To improve our website, content, and services based on how people use them
  • To process bookings and manage client relationships
  • To comply with legal obligations
  • To protect our website and users from fraud or misuse

We will never sell your data. Ever. That's not the kind of agency we are.

04. Cookies

Our website uses cookies, which are small text files stored on your device. They help us understand how people use our site and make it better. We use:

  • Essential cookies. Needed for the site to function properly.
  • Analytics cookies. Help us understand traffic and behavior (via tools like Google Analytics).
  • Marketing cookies. Used if you've interacted with our ads on platforms like Meta or Google.

You can control cookie settings through your browser at any time. Disabling cookies may affect some features of our site.

05. Third-Party Services

We work with trusted third-party tools to run our business. These may include:

  • Google Analytics, for website analytics
  • Meta Pixel, for advertising and retargeting
  • Calendly or similar, for appointment booking
  • Email marketing platforms (e.g. Mailchimp, ActiveCampaign)
  • WordPress and Elementor, for website infrastructure
  • Payment processors if applicable

Each of these services has their own privacy policy. We only work with platforms we trust and we never authorize them to use your data for their own purposes beyond what's necessary.

06. Data Sharing

We do not sell, rent, or trade your personal information. We may share your data only in these circumstances:

  • With service providers who help us operate our business (under confidentiality agreements)
  • When required by law, court order, or government authority
  • To protect the rights, property, or safety of Btch Agency or others
  • In connection with a business transfer or acquisition (you'd be notified)

07. Your Rights

Depending on where you're located, you have specific rights regarding your personal data. We respect all of them.

If you're in the United States (including California, CCPA):

  • Right to know what personal information we collect and how it's used
  • Right to request deletion of your personal data
  • Right to opt out of the sale of personal information (we don't sell it, but you have the right)
  • Right to non-discrimination for exercising your rights

If you're in Latin America (LGPD in Brazil, Ley Habeas Data in Colombia, and others):

  • Right to access your personal data
  • Right to correct inaccurate or incomplete data
  • Right to request deletion of your data
  • Right to data portability
  • Right to withdraw consent at any time
  • Right to be informed about how your data is being used

If you're in the EU/EEA (GDPR):

  • All of the above, plus the right to object to processing and the right to restrict processing

To exercise any of these rights, just email us at hello@btchagency.com. We'll respond within 30 days.

08. Data Retention

We keep your data for as long as necessary to fulfill the purposes outlined in this policy, or as required by law. If you ask us to delete your information, we'll do it promptly, unless we're legally required to keep it.

09. Data Security

We take reasonable technical and organizational measures to protect your data from unauthorized access, loss, or misuse. That said, no method of transmission over the internet is 100% secure, so while we do everything we can, we can't guarantee absolute security. What we can guarantee is that we take it seriously.

10. Children's Privacy

Our website and services are not directed at children under the age of 13 (or 16 in certain jurisdictions). We do not knowingly collect personal information from minors. If you believe a child has provided us with personal data, please contact us and we'll delete it immediately.

11. Links to Other Websites

Our site may contain links to third-party websites, including client sites, tools we recommend, and social media platforms. Once you leave our site, this privacy policy no longer applies. We're not responsible for the privacy practices of other sites, so read their policies too.

12. Changes to This Policy

We may update this privacy policy from time to time as our business evolves or laws change. When we do, we'll update the "Last updated" date at the top. If changes are significant, we'll let you know via email or a notice on our site. Your continued use of our website after changes means you accept the updated policy.

13. Governing Law

This policy is governed by the laws of the United States. For users in Latin America, we also comply with applicable local data protection laws including Brazil's LGPD, Colombia's Ley 1581 de 2012, Mexico's LFPDPPP, and Argentina's PDPA. In the event of a conflict, the more protective standard applies.
